Marc Bogutz is an experienced trial lawyer and appellate advocate who concentrates his practice on defending attorneys and other professionals, legal ethics, federal statutory litigation and insurance coverage matters. He is often retained to provide loss prevention services for insurance carriers and individual law firms.
Because of his vast experience defending legal malpractice cases and professional ethics claims, Marc is frequently invited to present continuing legal education programs and speak at conferences hosted by sections of the Pennsylvania Bar Association as well as numerous county bar associations. Additionally, Marc has co-authored and produced the Pennsylvania Bar Association’s statewide annual malpractice avoidance programs for many years.
Areas of Focus
In his professional liability practice, Marc has successfully defended many attorney clients and other miscellaneous professionals. In the representation of lawyers, Marc has defended large law firms and solo practitioners in a variety of disputes involving real estate, civil litigation, family law, probate and estates, class actions, corporate issues, wrongful use of civil proceedings/abuse of process and bankruptcy matters. As a former member of a Pennsylvania Supreme Court Disciplinary Hearing Committee, Marc draws from his unique insight and knowledge in advising and defending clients throughout the disciplinary process in Pennsylvania. In addition to representing lawyers, Marc’s experience extends to the defense of real estate professionals, insurance brokers/agents and other professionals. Marc has written and presented continuing legal education seminars on legal malpractice, strategies for the defense and early resolution of legal malpractice claims.
Marc defends federal and state court actions alleging violations of the Fair Debt Collection Practices Act (FDCPA), Fair Credit Reporting Act (FCRA), Pennsylvania Fair Credit Extension Uniformity Act (PAFCEUA), and Pennsylvania Unfair Trade Practices and Consumer Protection Law (UTPCPL). Marc’s approach to early evaluation and resolution prevents the potential exposure in these federal and state statutory cases and class actions from escalating into significant potential exposure for the client.
Marc has significant experience as a coverage lawyer representing domestic insurers in coverage disputes concerning environmental, professional liability, commercial general liability and first-party property damage claims.
